Beta-tester's Terms and Conditions of Use

By applying for an account on this site you signify your agreement with these terms and conditions. Please be aware that you are agreeing to participate in a trial of new software that will entail providing feedback on its use.

1.THE GUIDE

The term 'Guide' stands for the software product "An atlas of Ciliated Protozoa commonly found in aerobic sewage-treatment processes. An aid to monitor treatment-plant performance." by Colin R. Curds, Alan Warren, Humbert Salvadó Cabré & Dave Roberts.

2. ACCEPTANCE OF TERMS

This agreement is between the authors of the Guide and their agents (collectively "we" or “us”) and you and your agents (collectively “you”) regarding the use of the software product.

3. OWNERSHIP OF MATERIALS

The text, graphics and software (collectively "Content") in this in this application are licensed to you and remain the property of the Natural History Museum, London. You hereby agree not to distribute any portion of this application to any third party. The application is as beta-level for the purposes of testing and evaluation. Any third party may apply for their own copy and must also agree to these terms and conditions.
Files created with this software belong to you and are your sole responsibility.

4. PERMITTED LICENSE USES AND RESTRICTIONS; CONFIDENTIALITY

This licence allows you to install and use one copy of the Guide on any computer owned or controlled by you for evaluation and development purposes only. You make make copies for back-up purposes.
We are not obliged to offer any maintenance or technical support for this beta-stage product, although we will make every effort to do so.

5. CONSENT TO USE OF DATA

You agree to provide us with details of your installation configuration and comments on software performance. Any data supplied in this way will be made anonymous and put into the public domain under a Creative Commons non-commercial license.

6. DISCLAIMER OF WARRANTIES

This software is pre-release “beta” software that may be incomplete and may contain inaccuracies or errors that could cause failures or loss of data. You expressly acknowledge and agree that use of the software is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. To the maximum extent permitted by applicable law, the software is provided “as is”, with all faults and without warranty of any kind, and we hereby disclaim all warranties and conditions, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and of non-infringement of third party rights, all with regard to the software. We do not warrant that the functions contained in the software will meet your requirements, that the operation of the software will be uninterrupted or error-free, or that defects in the software will be corrected.

7. LIMITATION OF LIABILITY

You understand and agree that we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from any use of this software.
